A quotation is not accepted until Torq confirms the order; full payment is required before processing begins.
Busy-period production can take up to 10 weeks, starting from the order-ready date stated by Torq.
You approve the final design draft and must have permission to use every logo and artwork file supplied.
Measurements supplied by you are treated as accurate, so they must be checked carefully.
Bespoke products cannot normally be cancelled or returned simply because you change your mind.
Nothing in these terms removes rights relating to faulty, misdescribed or incorrectly made goods.
About these terms
These terms apply when you use torqsport.com, ask Torq Technical Clothing Ltd, trading as Torq Racewear, for a quotation or place an order that refers to them. Torq is registered in England and Wales under company number 08897832. Its registered office is 89 Pilkington Avenue, Sutton Coldfield, England, B72 1LG.
A quotation or order confirmation may contain product-specific terms, specifications, prices and timescales. If there is a direct conflict, the order confirmation takes priority for that order, except where the law does not allow a term to be changed or excluded.
If you buy as a consumer, you have statutory rights in addition to these terms. If you buy wholly or mainly for your trade, business, craft or profession, you are a business customer. Provisions that refer specifically to consumers or business customers apply only in that capacity.
Website use
The website provides general product, sizing, design and enquiry information. Product photographs, colours, specifications, availability and prices may change, and website content is not itself an offer to sell. Torq may correct errors and update or withdraw content without notice.
You may use the website for lawful personal or business enquiries. You must not interfere with its security, attempt unauthorised access, submit malicious files, scrape it in a way that impairs the service or use Torq content or branding without permission.
Quotations and orders
A consultation request or quotation does not create a contract. Your order is an offer to buy. A contract is formed when Torq accepts it in writing, normally through an order confirmation, and any required payment has been received. Torq may decline an order before acceptance, including where a product is unavailable, information is incomplete, artwork cannot lawfully be used or a price or specification contains an obvious error.
You are responsible for checking the customer name, product, quantity, specification, measurements, artwork, delivery details and any event date before approving the order. Tell Torq immediately if anything is wrong.
Prices and payment
The quotation or order confirmation will state the price, VAT and any delivery charge. Unless Torq agrees otherwise in writing, payment must be received in full before the order is processed. Production does not begin while payment or information required from you remains outstanding.
You must use an approved payment method and provide accurate billing information. Torq will not ask you to send payment-card details through the website consultation form.
Designs, proofs and approval
For customised products, Torq will provide a final design draft or proof for approval. You must check all wording, spelling, numbers, colours, logo placement, sizing references and other details. Production may begin after your approval, and later changes may be impossible or chargeable.
Torq aims to show scale and colour accurately. Screen settings, lighting, fabric colour, print method, material texture, dye strength and manufacturing tolerances can cause reasonable differences between a digital proof, sample and finished garment. These normal variations are not faults where the finished product remains consistent with the approved specification and description.
Logos and artwork
You confirm that you own, or have permission to reproduce, every copyright work, trade mark, sponsor logo, name, image and other material you supply or ask Torq to use. You are responsible for obtaining approvals from the relevant rights holders before final design approval.
Torq may ask for evidence of permission, refuse material that may infringe another person's rights or pause the order while permission is checked. You are responsible for reasonable loss or cost arising from a third-party claim caused by material you supplied without the necessary rights, except to the extent the claim was caused by Torq's own acts or omissions.
Measurements and fit
Measurements supplied by you, or by someone acting for you, are treated as accurate. Follow the current Torq measurement guidance, use the requested units and ask for help before approving an uncertain measurement. Torq is not responsible for fit issues to the extent they are caused by inaccurate, incomplete or incorrectly taken measurements supplied to it.
Torq will try to help resolve a measurement-related issue. Remaking, altering, collecting or redelivering a garment may involve an additional charge where the supplied measurements were inaccurate. This does not affect your rights if Torq made the garment incorrectly or it is otherwise faulty or not as described.
Production and delivery
Custom-suit production can take up to 10 weeks during busy periods. Torq will state when the lead time begins; this will normally be when full payment, final design approval, measurements and all other information needed for production have been received. Other products may have different lead times stated in the quotation or order confirmation.
Unless Torq expressly agrees a guaranteed date in writing, production and delivery dates are estimates. Torq will tell you about a material delay and take reasonable steps to minimise it. Consumer rights concerning late delivery remain unaffected, and nothing in these terms excludes liability that cannot lawfully be excluded.
Risk in the product passes to a consumer when it is delivered to the consumer or a person identified by them. For business customers, risk passes on delivery to the address or carrier stated in the order confirmation. Ownership passes only when Torq has received all sums due for the product.
Changes and cancellation
Ask Torq promptly if you want to change or cancel an order. Before production or committed design work begins, Torq may agree a change or cancellation and will explain any work already completed, supplier commitment or reasonable cost that must still be paid. Torq does not guarantee that an accepted custom order can be changed or cancelled.
Bespoke, personalised and made-to-measure products are created to your specification. The statutory change-of-mind cancellation right that can apply to distance purchases does not normally apply to those custom goods. Non-custom consumer goods may have a separate cancellation right where the law provides one.
Returns and product problems
Inspect the order as soon as reasonably possible. If a product is damaged, faulty, incorrect or not as described, contact info@torqsport.com with the order details and supporting photographs where useful. Do not continue using a product if doing so may worsen the issue or create a safety concern.
Torq will assess the issue and provide the remedy required by law, which may include repair, replacement, a price reduction or refund. Bespoke products cannot normally be returned because you changed your mind, selected the wrong approved design or supplied inaccurate measurements, but Torq may choose to offer help at its discretion.
Product use and safety
Use, store, clean and maintain each product in accordance with its label, supplied instructions, homologation and the rules of the relevant championship, venue or governing body. You are responsible for confirming that the selected product and approval are suitable and current for your intended event. Motorsport is inherently dangerous, and no garment can remove all risk.
Do not alter safety-critical construction, remove required labels or continue to use damaged protective clothing. Contact Torq if you need product or approval information before use.
Torq intellectual property
The website, Torq name and logos, product photography, templates, graphics, copy and Torq-created design work are protected by intellectual-property rights. Unless expressly agreed in writing, Torq retains those rights. Buying a product does not transfer ownership of the underlying template, artwork, manufacturing file or brand assets.
You may use photographs of your finished product and your own logos in the ordinary way. You must not reproduce, sell, distribute or provide Torq templates or production-ready design files to another manufacturer without written permission.
Responsibility and liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of rights that cannot legally be excluded, or any other liability that the law does not permit Torq to exclude.
Torq is responsible for foreseeable loss caused by its breach of these terms or failure to use reasonable care and skill. It is not responsible for loss that was not foreseeable, was caused by inaccurate information or unauthorised artwork supplied by you, or could reasonably have been avoided by following Torq's instructions.
For business customers only, Torq is not liable for indirect or consequential loss, loss of profit, revenue, business, anticipated savings or goodwill. Subject to the liabilities that cannot be limited, Torq's total liability to a business customer arising from an order will not exceed the total price paid or payable for that order. Consumer statutory rights are not restricted by this business-customer limitation.
Events outside reasonable control
Torq is not responsible for delay or failure caused by events outside its reasonable control, such as carrier disruption, material shortages, manufacturing interruption, industrial action, natural events, war, public-health restrictions or failure of essential utilities. Torq will notify you where practical, take reasonable steps to reduce the effect and resume performance when possible. Any statutory right to end the contract because of a serious delay remains unaffected.

General terms
Torq may transfer its rights and obligations under a contract to another organisation, but this will not reduce a consumer's rights. You may transfer your rights only with Torq's written agreement, except where the law gives you a right to do so.
If a court finds part of these terms unlawful, the remaining terms continue. A delay in enforcing a right does not waive it. No person other than you and Torq has a right to enforce the contract, except a permitted successor or transferee.
Governing law and contact
These terms and each contract are governed by the law of England and Wales. The courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere in the United Kingdom, you may also bring proceedings in the part of the UK where you live and retain any mandatory local protections.
